Requirement for contractors to provide A1 Forms while working in the EU

Anyone working in the EU as a contractor or a permanent member of staff is required to pay social security in the EU.

An individual resident in one EU country but working in another is described as a “Posted Worker”. Under EU legislation Posted Workers can pay social security in the country they are working in, but many choose to continue paying social security in the country of residence under their local system at local rates.

As part of our agreement and as required under EU law Excel Technical Consulting have to be able to provide evidence that our contractors are making social security contributions in the EU if requested, usually via Portable document A1.
This is an EU-wide document that along with some other information certifies your social security status and confirms no obligation to make payment in another member state as detailed here: https://www.ela.europa.eu/en/glossary/a1-form

Use of UK Umbrella or Payroll Companies

While UK Umbrella companies were previously acceptable (and still are for UK residents working in the EU) following Brexit this is no longer the case as UK is not an EU member.
Unless you have a UK address and National Insurance reference we will not be able to make payments into UK companies for EU resident contractors.

Are A1s available for sole traders as well as Limited companies?

They are available for both sole traders and Limited companies

How long does an A1 application usually take?

It depends on country but anywhere from 14 days to 4 months

Are there any additional requirements for A1 to be issued?

For Limited companies the contractor has to be an employee i.e. receiving income and not only dividend from the company.

Some countries require the company to have carried out business locally before posting a worker, this and the duration varies from application to application

What happens if my A1 application is refused?

This does not necessarily mean you are unable to continue working in another country, however we may have to consider an alternative payroll solution  

Is proof of Social Security registration/payment no longer acceptable?

We will still ask for this information from you but the A1 Form is now required for most locations

And if I refuse to apply?

If you refuse Excel will not be able to provide you with work within the EU
